AI Kill Switch Act Raises Questions for CIOs

Proposed federal legislation would require powerful AI systems to support shutdown and intervention capabilities.

The AI Kill Switch Act, introduced by Reps. Ted Lieu and Nathaniel Moran in July 2026, would require developers of certain powerful AI systems to maintain the ability to throttle, suspend, or shut them down.

The bill targets frontier model developers and initial systems builders with at least $500 million in annual revenue from covered technology, likely limiting its reach to major players.

CIOs are already negotiating similar kill-switch provisions into vendor contracts ahead of regulation, seeking control mechanisms for AI systems they cannot fully manage. Legal expert Monique Bhargava explains that liability allocation remains complex, since companies cannot claim they lack control over AI outcomes.
